NEARMAP EVENT SWEEPSTAKES OFFICIAL RULES
The offer to enter this sweepstakes is only valid for individual persons who are eligible by meeting the following criteria (each a “Participant”):
(a) not currently an existing Nearmap customer, Nearmap employee or employee of an existing Nearmap customer;
(b) 18+ years of age;
(c) Resident of the United States;
(d) Be the authorized account holder of a valid company email address; and
(e) Have completed participation in a demonstration given by Nearmap at the CREtech New York 2024 event by November 14, 2024 (the “Event”).
· By entering the Sweepstakes, Participant agrees to these terms and conditions and represents and warrants that it meets the eligibility requirements herein.
· Eligible Participants who elect to be entered will be entered into a sweepstakes (the “Sweepstakes”) to win a pair of Apple AirPods Pro 2 valued at $249.00 ARV (the “Prize”). The Prize cannot be substituted for any other item, cash or credit. To enter, Participants must provide Nearmap with their name and valid company email address for which the Participant is the authorized account holder.

Lehi UT, 84043 (“Nearmap”).
· No purchase necessary to enter or win the sweepstakes. A purchase will not increase chances of winning.
· One entry per individual.
· Winning Prize is subject to all applicable laws and is void where prohibited by law.
· Entries may be made by Participants from 9:00 am EST on 13 November 2024 until 5pm EST on 14 November 2024 (the “Sweepstakes Entry Period”).
· Odds of winning depend on number of eligible entries received during the Sweepstakes Entry Period.
· Winners will be selected via a random drawing conducted on or about November 14 from all eligible entries received during the Sweepstakes Entry Period. Winners will be notified by mail/email and may be required to complete, sign and return an Affidavit of Eligibility & Release of Liability, and where permissible, a Publicity Release (collectively the “Release”) requested by Nearmap within ten (10) days from date specified on notification, or the corresponding entry will be disqualified. Participant must respond to the Notice with a valid shipping address to receive the Prize. Prize will be shipped to the winner at the shipping address provided, at Nearmap’s expense, approximately thirty (30) days after Nearmap’s receipt of winner’s shipping address. Nearmap shall have no liability if notification is lost, intercepted, or not received for any reason. Nearmap is not responsible for any change in winner’s email account or other contact information after entering the Sweepstakes that may interfere with winner notification. If an email notification is returned as undeliverable, or if any winner fails to execute and return any document required by Nearmap within the time allocated, or if a winner cannot accept Prize for any reason (including but not limited to regulations specified by his/her employer), or if he or she is not in compliance with these Official Rules, the corresponding winner will be disqualified and Nearmap may, in its sole discretion, award or not award the forfeited or disqualified Prize to an alternate winner.
· Winning Prize is offered to winning Participant only and may not be assigned to anyone else.
· Except where prohibited by law, by accepting the Prize, the winner consents to the use of his/her/their name, Prize won, photograph, likeness, statements and limited biographical information (city and state of residence) for publicity or advertising purposes in all media worldwide, including but not limited to social media, without limitation and without further compensation or notice. Furthermore, Nearmap and/or its agents may film, record and/or take photographs of the winner (and guest) before/during/after the Event and may use the resulting footage, recordings, or photographs for a range of purposes, including, without limitation, for marketing and promoting Nearmap and/or its promotion partners/agents and their respective products and services. No additional compensation will be provided for any resulting footage.
· Entrants and any coordinating entity (“Releasing Parties”), release, defend and hold harmless Nearmap and its respective owners, members, shareholders, officers, directors, partners, equity holders, agents, representatives, employees and all others associated with the development and execution of this Sweepstakes (collectively, “Releasees”) from and against any and all claims, actions, causes of action, suits, liabilities, debts, dues, sums of money, accounts, reckonings, bonds, bills, specialties, covenants, contracts, controversies, agreements, promises, variances, trespasses, lost profits, indirect or direct damages, consequential damages, incidental damages, punitive or exemplary damages, judgments, extent, executions, claims and demands whatsoever, in law, admiralty or equity, whether known or unknown, foreseen or unforeseen, against Releasees which any one or more of the Releasing Parties ever had, now have or hereafter can, shall or may have which in any way arise out of or result from Entrant’s participation, or acceptance and use or misuse of Prize (if determined a winner).
· The “authorized account holder” is defined as the natural person who is assigned the email address by his/her/their employer and/or Internet access provider, online service provider or other organization responsible for assigning email addresses as shown on his/her carrier’s records for the domain associated with the submitted address. Winners may be required to show proof of being the authorized account holder. No responsibility or liability is assumed by the Nearmap for technical problems or technical malfunction arising in connection with any of the following occurrences which may affect the operation of the Sweepstakes: Hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, fax or Internet connectivity or other online or network communication problems; errors, omissions or limitations of any Internet providers, servers, hosts or other providers; garbled, jumbled or faulty data transmissions; failure of any online transmissions to be sent or received; lost, late, delayed, incomplete, inaccurate, damaged, destroyed, misdirected or not received or intercepted transmissions; inaccessibility of any website in whole or in part for any reason; traffic congestion on the Internet or any website; unauthorized human or non-human intervention of the operation of the Sweepstakes, including without limitation, unauthorized access, tampering, hacking, theft, virus, bugs, or worms; or destruction of any aspect of the Sweepstakes, or loss, miscount, misdirection, inaccessibility or unavailability of any email used in connection with the Sweepstakes; any errors, omissions, interruptions, deletions, defects, delays in operation failures or human error that may occur in the transmission, receipt or processing of entries, or for deletion, theft or destruction of, unauthorized access to, or alteration of, entries; causes beyond Nearmap’s reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Sweepstakes; any entries submitted in a manner that is not expressly allowed under these Official Rules (all such entries will be disqualified); or cheating or fraud by any Participant. Nearmap is not responsible for any typographical errors, any incorrect or inaccurate information, whether caused by Participants, site users, tampering, hacking, or printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; in the announcement of Prize or these Official Rules, or any inaccurate or incorrect data contained on any website.
· Nearmap is not responsible for any personal injury or property damage or losses of any kind which may be sustained to user’s or any other person’s computer (hardware or software) and/or other device related to or resulting from participation in the Sweepstakes or the acceptance or use of any prize awarded. The use of third-party software or website or automated entry systems to participate is prohibited, and Nearmap reserves the right to disqualify entries made in such fashion. Nearmap is not liable if any portion of the Sweepstakes is canceled due to weather, fire, strike, acts of war or terrorism, or any other condition beyond its control.
· The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
